Checklist for applications that require Native Title Notification

Please use the following checklist to ensure that your application is complete. Information provided by applicants may be presented to Native Title claimants and their Representative Bodies as part of the notification process.

General description of the activity
  A detailed description of the type and nature of the activity is required including for example, research details, research objectives etc..

Description of the location in which the activity is to take place. In order to comply with the notification requirements of the Native Title Act 1993 (Cth) an explicit description of the location/s must be provided and include the following:

  • A defining of the boundaries of the area (including points of latitude and longitude), where the proposed activity is proposed to be undertaken, and reference to particular land marks or other suitable geographic features, (for example bays, reefs, rivers, impoundments, land points, points of local reference etc;

and

  • include a detailed map of the area of the proposed activity, showing the boundaries of the area

Detailed description of the activity proposed.
The application will need to provide greater details about the proposed activity. This should include but is not limited to the following items:

Boat details
Boat name, length, tonnage (if relevant), surveyed maximum carrying capacity, usual home port, number of ancilliary boats, their dimensions and carrying capacity.

Frequency of activity
The intended frequency of the proposed activity. Will the activity be undertaken on a daily/weekly/monthly basis? If the activity has been undertaken in the past, indicate what has been the usual activity frequency.

Expected number of persons involved in the proposed activity
For example, the number of persons involved, identity, supervisors qualifications etc.

Expected fish catches
For example, details of the sample size of fish to be taken, species details, and, where large samples are proposed, reasons for same. If the activity has been undertaken in the past, indicate what the total fish catch for a typical year has been.

Fishing apparatus
For example, the number of rods and lines or handlines, number of hooks, number to be used per operation, spearfishing equipment, number of pots, dillies, nets, traps, and other equipment, a detailed descrpition of apparatus (dimensions, mesh size, etc), and in particular special apparatus if is not normally available for use (for example, nets)

Contact with indigenous persons in the process of the proposed activity
Applicant's knowledge of traditions and customs of indigenous people. Are there any known sites of significance in the proposed area of operation. Are there Prospects of indigenous persons gaining employment in the operation?
